Lieutenant General Shadrack Sibiya, a suspended deputy national police commissioner, is scheduled to appear before the Randburg Magistrate’s Court to formally request bail on five allegations, including human trafficking, sexual grooming, and rape.
The bail hearings in the previously postponed case will resume in court on Tuesday. Sibiya, who has been the subject of an inquiry by a task force looking into issues from the Madlanga Commission, was taken into custody last Monday and made his initial court appearance the following Tuesday to answer to the accusations.
The State alleges that Sibiya raped an 18-year-old woman at a Sandton hotel on May 16, 2026, after she had been given alcohol and lost consciousness. According to a charge sheet seen by IOL, Sibiya had taken the woman and two others to The Grand, a strip club in Sandton, where he allegedly bought them food and plied them with alcohol, continuing to do so afterward at the Garden Court Hotel.
The charge sheet states: “When the complainant had passed out, the accused raped her and on his way out of the hotel room, he boasted to the complainant’s friends that she was very nice and still a virgin.”
Sibiya is also accused of grooming a 16-year-old girl via WhatsApp between July and August 2026, allegedly sending her nude photographs of herself, persuading her to send videos of herself masturbating, and possessing and distributing sexual images of her. The State alleges the girl’s father described as an associate of Sibiya gave him her contact details in July to arrange transport.
In addition, Sibiya faces charges of trafficking three people for sexual exploitation, relating to alleged incidents between May 16 and August 3.
Sibiya has been remanded at Kgosi Mampuru II Correctional Centre in Pretoria. The State has said it holds intelligence suggesting he might attempt to escape if held at a police station, including Johannesburg Central Police Station.
Legal and institutional reactions
Legal expert Nthabiseng Dubazana, founder and managing director of Dubazana Attorneys, has said the seriousness of the charges could require Sibiya to apply for bail under Schedule 6 of the Criminal Procedure Act meaning he would need to demonstrate exceptional circumstances to secure his release.
She noted that a conviction could result in a lengthy prison sentence and the loss of his position within the South African Police Service, adding that the case underscores the need for more rigorous vetting of senior police officers, including proper lifestyle audits.
National police spokesperson Brigadier Athlenda Mathe said the Commission’s Recommendations Task Team had strong evidence in the matter, stating that when the team brings a case before court, it does so with overwhelming evidence.
She said SAPS stands in solidarity with the alleged victims and is intensifying its efforts to combat gender-based violence and femicide.
Criminologist Professor Kholofelo Rakubu of Tshwane University of Technology stressed the importance of separating the allegations from broader institutional concerns raised by the case, noting that Sibiya remains presumed innocent unless a court finds otherwise.
She said the case could test morale among junior officers tasked with enforcing sexual-offences and child-protection laws, but added that public confidence is ultimately strengthened not weakened when senior officials can be seen to be investigated independently and without interference
